So I renewed my apartment lease early in June, which apparently cancelled the auto pay I had set up for my rent. So when I come back from Houston yesterday, there’s an eviction notice on my door that was put their that day. I go online and figured out what happened and payed the rent for June, then went to the leasing office this morning to make sure everything was good now, which they said it was.

Anyway, the thing that bothers me, is they never called or emailed me about the late rent before putting the eviction notice on my door. If I’d stayed in Houston for a extra couple of days I might’ve come back to a lock out, and a simple fucking email or phone call between the 3rd and the 10th could’ve avoided the whole situation.

I had something similar happen with AT&T when I moved. It’s not that hard to make a call and say hey umm we have not heard from you in a while....

I got an eviction notice from my apartment last December. Their autopay system had failed, and that’s how they responded. Awful customer service (they did later send an email explaining the autopay problem). Also they put the notice out on the 5th (usually they didn’t post process the autopay until the 5th or 6th) , so it’s not like if even if I had been watching my account like a hawk I would have had any reason to be suspicious that they payment didn’t process. It’s also weird that they went right to the eviction notice, this was far from the first time they had autopay problems (though it had been working well for a while), and in the past they had just sent late notices and demanded a late fee (as noted in the lease, I don’t think immediate eviction was something they can legally enforce), and were always happy to waive the late fee since it was their system that failed. They were happy to waive it in this case too, but it was still really off-putting , and given their obvious incompetence, left me worried that someone was still going to show up in two days to try and kick me out.

Same here, when I first saw it, I thought it was just a warning, but it said I had till the 13th to move out.

Something very similar happened to me, recently. I got so caught up in paying the bil l s that my now-ex girlfriend used to pay that I forgot to pay the rent this month. There’s like a 3 or 4 day grace period, but I never got ANY notice or anything until last week, when I came home to a big “ FINAL NOTICE” thing on my door. One hundred-dollar late fee later, everything was settled. On one hand, I feel like I deserve that refunded, but on the other hand I WAS late.

I just narrowly avoided some similar nonsense, on a lesser scale, with my utility company. I moved to a new city, but have the same company. My dad called Sunday to tell me I got a letter (at my parents’ house that was never on my account information with them), saying I got a final notice to pay a missed bill.  No prior attempts at communication to my knowledge.  Just a “pay now or else” notice.

Turns out that my auto-pay, which was still set up, doesn’t get triggered for final payments.

When was rent due? In Utah at least you have to give notice of 3 days before you can start court proceedings to evict. You also can’t “self evict” by changing the locks, even after the 3 days is up.

I had similar problems and response from my last apartment. Also Geico. I used to have a problem where autopay would get rejected (problem on my bank’s side). Their response was to immediately send me 2-3 emails notifying me of termination of my insurance coverage. Why 2-3? No idea. Also they’d send the same number of letters, so even after everything cleared up I’d get a bunch of nastygrams in the mail two weeks later ...

I don’t understand why companies immediately go to DEFCON 11 for an otherwise good customer.

Lots of things get done that aren’t within the law.  But people get away with it because they don’t bother with the time and expense of filing a lawsuit to enforce the law.

I want to say the OP is in San Antonio. While I don’t remember all the specifics, I do know that in general, landlord tenant laws in Texas are much more heavily tilted in favor of land lords than many other places . Texas law does allow for tenant lockout provision in leases, and it also allows for landlord’s liens to be placed on tenant’ s property that can sometimes be enforced without a judicial process for simply being behind on rent.

Back when I was playing paralegal, we had a commercial real estate case involving a restaurant (in New Mexico), where the landlord from El Paso was trying to enforce all kinds of eviction and lockout provisions in the lease that were illegal and unenforceable in New Mexico. We represented a third party contractor in the case who was owed money by the owner and had valid liens (that were in the process of being enforced)   against some of the equipment in the building the landlord was trying to lock the tenant out of. That land lord got shut down pretty much instantly and learned he had to go through a much slower eviction process in New Mexic o, in which he didn’t get to hold property hostage and is much, much more favorable to tenants than he was used to dealing with.

They’re not. Eviction notice first , then lawsuit has to be filed and local JP has to approve the eviction .
